What is guardianship nomination?
A guardianship nomination document appoints the individual(s) you would like to care for your minor child(ren) if you and the other natural should die or become incapacitated.
There are several types:
· Permanent Guardian: to take legal and physical custody to care for your minor child.
· Temporary Guardian:to take physical custody until the permanent guardian becomes available (for example if the permanent guardian is out-of-state).
· Conservator: person who manages the estate (property) of the minor. This can be the same as the permanent guardian or can be someone different like the Trustee of a Trust.
Why nominate a guardian?
If you have minor children and something happens to you and the other parent, your child becomes a ward of the state and a Court will appoint guardians for them. Your child could be put into the foster care system. Also, if there is any conflict among family members about who the guardian should be, there could be a long court battle.
How do I choose a guardian?
Nominating a guardian, and an alternate guardian, can be a very difficult decision for any parent, however, it is important to remember that any decision you make is better than any decision a court would make for you.
